The European Union Trademark Court has ruled 100% in favor of Niche Perfumes in its battle against Danbel Premium S.L. over the use of its trademark. The judgment issued on July 12, 2024 orders the Sol Puig family company to immediately cease using the trademark Perfumes Niche, as well as any other trademark that, due to its graphic or phonetic similarity with the registered trademark of Niche Perfumes, could lead to confusion among consumers.
According to the Judgment, Danbel Premium S.L. Niche Perfumes has the obligation to compensate Niche Perfumes with one hundred percent of the profits it would have obtained by using the trademark owned by Niche Perfumes improperly.
According to the lawyer Jaime Olcina, who represents the interests of Niche Perfumes S.L. in this legal battle, said compensation could range between 10 and 20 million euros, which the Sol Puig family would have to face if the competent court so deems. In addition, Danbel Premium S.L. is sentenced to pay €1,200 daily in compensation if it does not stop using the trademark on any medium.
Niche Perfumes has welcomed the decision and has stated that it does not intend to allow anyone to use its trademark or any other that could mislead consumers by being graphically or phonetically similar, having demonstrated with this first sentence its determination to pursue the infringers and make them pay with the full weight of the law. Likewise, Niche Perfumes has recalled that its trademark is registered throughout the European Union.
